The DBPOA has implemented significant changes in the past couple of years. It has erroneously resolved that we are governed by the Davis-Stirling Act. These laws pertain to developments with COMMON INTEREST PROPERTY which the association takes care of. We have NONE! The DBPOA does nothing more than dictate what your property can look like and how you can use it. And you pay them to do this! You also pay for mistakes they make, such as the recent assessment to pay the costs awarded to the homeowner they lost in court to and should never have sued.
They have also contracted with a management company (AMC) to run the daily affairs of the association. This is a “for profit” company which is not limited in what they can charge for extra services. We no longer have control over dues increases (regardless of what our governing documents say) or other operating expenses…
But this is still OUR
association and we do still have the power and authority to voluntarily
dissolve it. This requires the majority
of our members to sign an agreement to DISSOLVE the DBPOA. You do NOT have to be a member in good standing to sign.
